Lien Waivers & Roofing Subcontractors – What You Need to Know

I’m going to assume that since you’re reading this post, you or someone you know is interested in buying or replacing a roof. I’m also going to guess that there’s a good chance that you’ve already called other roofing contractors besides us here at Lianro Metal Roofs.

If you’re like most of our customers, you’re probably feeling hesitant and uncertain about buying a roof because all contractors appear to be the same and every competitor says their quality and service are the best.

So I understand that you might be skeptical of roofing contractors in general; especially one like us that claims their roofs are head and shoulders above their competitors’ since we avoid the long delays in starting and completing your project, don’t use scraggly looking workers, and have completely done away with the shoddy workmanship typically associated with the roofing industry.

You see, at Lianro Metal Roofs, we do some things that are very unique to our industry. Whether or not you ultimately do business with us is completely up to you. I just want to make sure that you understand how the roofing business works so you can feel confident that you are making the best decision possible – whomever you end up buying from.

To us, it seems pretty obvious that our customers want a good quality roof that goes on quickly and on schedule, stays looking new for a long time, doesn’t need to be repaired or replaced every few years, and is installed by clean, friendly well mannered workers. In fact, we constantly survey and question our customers, and that’s exactly what they’ve told us.

But where most customers get burned is that they are not even aware that the contractor they use makes all the difference in the world. You see, the roofing industry is one of the most unregulated industries in the country. I’m sure you’ve heard all the horror stories on Dateline and 60 Minutes about unscrupulous contractors taking money up front and then skipping town; or collecting from you in full and failing to pay their sub-contractors – who in turn attach a lien to your home – preventing you from selling it and requiring you to hire legal counsel to fight the action – all at your expense of course. 

And if you happen to be one of the lucky ones that can get a financial judgment against your contractor, they just close the business and re-open the next week under another name. It’s no wonder that the roofing industry has the second worst reputation in the country – falling just behind used car salesmen.

That’s why at Lianro Metal Roofs, we wanted to do something about this. Since the industry isn’t regulated, we decided to create our own standards and enforce them on ourselves.

These standards govern 4 major areas that protect our customers: reputation, stability, workmanship, and professionalism and are promised in our Code of Ethics and Roofer Competency Promise.

Some quick examples. When it comes to reputation, a roofing contractor should be able to produce upon demand 6 reference sources such as their current business license, BBB report, current references that are within the past 30 days, trade association memberships, written bids detailing the job requirements – not just a simple invoice, and not requiring any money up front to begin the job.

To determine if the company is stable, you should demand 4 things from the contractor: first and foremost – a supplier lien waiver letter that frees you from obligations to pay any sub-contractors they hire – but fail to pay; their general liability certificate to insure they have real insurance and are not just “self-insured.” A letter from their bank indicating the stable financial condition of their company; and a supplier status letter detailing their relationship with their materials suppliers.

At Lianro Metal Roofs, all of our crew members are employees, and not subcontractors.

Workmanship comes with 4 requirements: a certified contractor status letter that the contractor has been certified to apply the proper materials; worker certification status that the workers are also certified – not just the contractor. A certification of technical competency that proves they have technical competency in the materials applications of the products they are using. And finally, a quality compliance audit that demonstrates they are inspecting every step of the installation and workmanship as the job progresses through various stages. Most contractors only inspect the job upon completion – and fail to catch defects that the workers were able to cover up once the job was completed.

Professionalism and service comes with 4 requirements. A written sub-contractor agreement that holds sub-contractors accountable to behavioral standards and background checks to avoid theft of your property or a danger to your family members. Proof of frequent supervisor job inspections of the project; no-delay communication policy guaranteeing you can reach someone immediately in case of a question or concern. And finally, a daily job clean-up roster that insures your property will remain neat and presentable during every phase of the installation.
